Terms of Service

1. Acceptance

By downloading, installing, or using Kotka ("the Software"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Software.

2. License

Kotka is proprietary software. Upon purchase or download of a paid tier, you are granted a limited, non-exclusive, non-transferable, revocable license to install and operate the Software on Minecraft server instances you own or administrate.

• The Community (free) build may be used on any number of servers without charge.
• Server and Network tier licenses are per-account and may not be shared, resold, or sublicensed.
• You may not redistribute, repackage, or publish Kotka binaries through any third-party platform without prior written consent.

3. Restrictions

You may not:

• Reverse engineer, decompile, disassemble, or otherwise attempt to derive source code from the Software, except where expressly permitted by applicable law.
• Modify, create derivative works of, or remove any proprietary notices from the Software.
• Use the Software to facilitate cheating, exploit development, or any activity that violates Mojang's Terms of Service or applicable law.
• Circumvent or attempt to circumvent any license enforcement mechanisms.

4. Source Code Access

Source code access is available exclusively under the Network tier and is governed by a separate confidentiality agreement. Recipients may not share, publish, fork, or use the source code outside the scope of that agreement.

5. Updates and Support

We may release updates to the Software at our discretion. Paid tier subscribers receive priority access to updates and bug fixes. We reserve the right to discontinue support for any version at any time with reasonable notice.

6. Disclaimer of Warranties

The Software is provided "as is" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Software will detect all cheating activity or operate without interruption or error.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Kotka and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Software, even if advised of the possibility of such damages.

8. Termination

We may terminate your license immediately if you breach any provision of these Terms. Upon termination, you must cease all use of the Software and delete all copies in your possession.

9. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved in the jurisdiction where the developer resides.

10. Changes to These Terms

We reserve the right to update these Terms at any time. Continued use of the Software after changes constitutes acceptance of the revised Terms. Material changes will be communicated via the changelog or contact email.
